Terms of Service

These Terms of Service (“Terms”) govern your access to and use of IslandApp (“we,” “our,” or “us”). By creating an account, accessing, or using IslandApp, you agree to be bound by these Terms. If you do not agree, you must not use IslandApp.

1. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use IslandApp. If you use IslandApp on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

2. Account Registration

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities under your account.

3. Services

IslandApp is a cloud-based Learning Management System (LMS) supporting SCORM/xAPI content, live webinars, and multi-tenant access. We reserve the right to modify, suspend, or discontinue features at any time without liability.

4. Acceptable Use

You agree not to:

• Upload, distribute, or use content that violates intellectual property rights, privacy rights, or applicable laws.
• Upload malicious code, viruses, or attempt to disrupt our infrastructure.
• Share your account credentials or bypass security features.
• Use IslandApp for unlawful purposes or in violation of Saudi law or applicable international regulations.

5. Content Ownership

• You retain ownership of content you upload to IslandApp.
• By uploading content, you grant us a limited, non-exclusive license to store, display, and process it solely for providing the service.
• For multi-tenant organizations, tenant administrators may access user-generated content as part of platform administration.

6. SCORM/xAPI & Third-Party Content

You are responsible for ensuring that SCORM/xAPI packages and other learning materials comply with copyright laws and do not infringe third-party rights. We are not liable for content accuracy, completeness, or compliance of third-party materials.

7. Subscriptions, Billing & Refunds

• Subscriptions are billed in advance on a recurring basis (monthly or annually) according to your plan.
• Prices are subject to change with prior notice.
• All fees are non-refundable except where required by law or stated otherwise in writing.
• Non-payment may result in suspension or termination of service.

8. Data Protection & Privacy

We process your personal data in accordance with our Privacy Policy, which forms part of these Terms. By using IslandApp, you consent to our data practices as described therein.

9. Service Availability & Maintenance

We aim for high availability but do not guarantee uninterrupted or error-free service. Scheduled maintenance and emergency downtime may occur.

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms or applicable laws.
• Fail to pay subscription fees.
• Engage in abusive or fraudulent activity.

Upon termination, your right to access the service will cease immediately.

11. Disclaimers

IslandApp is provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses arising from your use of IslandApp or violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute shall be resolved through amicable negotiation, failing which it shall be submitted to the competent courts of Riyadh, Saudi Arabia.

15. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via the app or email. Continued use of IslandApp after changes take effect constitutes acceptance of the updated Terms.
